Terms of Service
These Terms of Service govern your use of Elopics, a photo rating service where users upload photos, browse rankings, and rate photos shown in the app. By creating an account, uploading content, or using the service, you agree to these Terms.
1. Who May Use the Service
You may use the service only if all of the following are true:
- You are at least 18 years old.
- You can form a binding agreement under applicable law.
- You are not prohibited from using the service under any applicable law or prior suspension.
2. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for activity that occurs through your account.
- You must provide accurate information where the service requires it.
- You must notify the service operator if you believe your account has been accessed without authorization.
3. Acceptable Use
You agree not to:
- Use the service for unlawful, abusive, or deceptive purposes.
- Impersonate another person or misrepresent your identity.
- Harass, threaten, or target other people through the service.
- Upload content that is illegal, infringing, defamatory, or harmful.
- Attempt to scrape, reverse engineer, or disrupt the service.
- Use automation, fake accounts, scripts, or coordinated behavior to manipulate ratings, rankings, or other activity.
4. User Content and Upload Rules
“User Content” includes photos, profile details, captions, names, metadata, and other information you submit.
- You may upload only content you own or have the legal right and permission to use.
- If you upload a photo of another person, you represent that you have their permission or another valid legal basis to do so.
- You must not upload intimate, explicit, or otherwise highly sensitive images unless the service expressly permits that content.
- You understand that content submitted to the service may be shown to other users for rating, ranking, and related product features.
5. License You Grant
You retain ownership of your User Content. However, by submitting User Content, you grant the service operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and distribute that content only as needed to operate, improve, secure, and support the service.
6. Ratings, Rankings, and User Opinions
- Ratings and rankings are generated from user activity and system calculations.
- Ratings and rankings are not statements of fact, quality guarantees, or endorsements.
- The service does not guarantee that rankings are complete, accurate, unbiased, or free from change over time.
7. Moderation and Enforcement
The service operator may, but is not required to:
- Review, monitor, remove, or restrict content.
- Suspend or terminate accounts.
- Investigate conduct that appears to violate these Terms or applicable law.
The service operator may take these actions at any time, with or without prior notice, to protect users, the platform, or third parties.
8. Intellectual Property
Except for User Content, the service and its interface, branding, code, and design elements are owned by the service operator or its licensors and are protected by law.
9. Privacy
Your use of the service is also governed by the Privacy Policy. If these Terms and the Privacy Policy conflict, the Privacy Policy governs privacy and data handling issues.
10. Termination
You may stop using the service at any time. The service operator may suspend or terminate your access at any time if it believes you have violated these Terms, created legal risk, or misused the service.
11. Disclaimers
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the service operator disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, the service operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the service.
13. Changes to These Terms
The service operator may update these Terms from time to time. If that happens, it may update the effective date, post the revised Terms, and where appropriate provide additional notice.
14. Governing Law and Disputes
These Terms are intended to be interpreted in a commercially reasonable way consistent with applicable law. Any dispute related to the service should first be raised through the service's support or contact channel so the parties can try to resolve it informally.
